Terms of Service.
This document is a translation of the Polish Terms of Service (Regulamin). In the event of any discrepancy between the Polish and English versions, the Polish version shall prevail.
These Terms of Service govern your use of the website available at https://ai.in-thecity.com (the "Service"). By using the Service or creating an account, you agree to these Terms of Service.
1. Definitions
- Operator — EAST WEST CONSULTING sp. z o.o., registered in Gdańsk, ul. Aleja Grunwaldzka 472, 80-309 Gdańsk, Poland. KRS: 0000602766, NIP: 8371818070, REGON: 363760385.
- Service — the online platform available at https://ai.in-thecity.com.
- User — an individual using the Service with a registered account.
- Account — an individual User account in the Service.
- Free Plan — free access to the Service with limitations described in Section 6.
- Pro Plan — paid access through the purchase of a credit package.
- Credit — a billing unit used to generate a Guide. The cost depends on the length of the video being analysed.
- Package — Pro Pack 10 or Pro Pack 50, a one-time purchase of a set number of Credits.
- Guide — the result of AI-powered analysis of a publicly available video.
- AI / AI Models — generative language models (LLMs and multimodal models) provided by certified AI service providers, used to analyse content and generate Guides.
2. General Provisions
2.1 Nature of the Service
The Service is an AI-powered tool that:
- analyses publicly available videos from platforms such as YouTube,
- generates structured travel guides (list of places, prices, quotes, map),
- presents the results in a clear format.
The Operator is NOT:
- a travel agency or tour operator,
- a booking intermediary,
- a travel services provider,
- a travel or culinary advisor,
- the owner of any video content analysed by the Service.
2.2 No Guarantee of Results
The Service delivers the output of an AI model based on publicly available data. The Operator does not guarantee that a generated Guide will be 100% accurate or up to date, complete in every respect, aligned with the User's expectations, or consistent with the original video creator's subjective views.
3. Technical Requirements
To use the Service, the following are required: internet access; an up-to-date web browser (Chrome, Safari, Firefox, Edge — latest versions); cookies enabled (at least necessary cookies); JavaScript enabled; an active e-mail address.
4. User Account
4.1 Age Requirements
- Free Plan — minimum age 16. Users aged 16–17 may only use the Service with parental or guardian consent.
- Pro Package purchase — minimum age 18 (as required by the payment processor, Stripe).
4.2 Registration
An account may be created by providing an e-mail address and setting a password, or via OAuth login through Google. The User must provide a genuine, active e-mail address.
4.3 Account Security
The User is responsible for keeping their password confidential and for all actions taken under their account. They must notify the Operator immediately of any unauthorised access (support@in-thecity.com).
4.4 One Account Per Person
Each User may hold only one active account. Creating multiple accounts to circumvent Free Plan limits or the referral programme is prohibited (Section 12).
5. Use of AI Models
5.1 AI Providers
The Service uses generative AI models (LLMs and multimodal models). The Service currently uses Google Gemini models (Google LLC, USA). The Operator does not train its own AI models.
5.2 AI Hallucinations — Key Notice
AI models may generate inaccurate, incomplete, or false information (known as "hallucinations"). This is an inherent limitation of AI technology and is independent of the Operator. In particular, the following may occur: incorrect addresses or coordinates of places; outdated prices; places that no longer exist; incorrect opening hours; misattributed quotes or inaccurate attribution; plausible-sounding but fabricated facts.
5.3 User's Obligation to Verify
Users are required to independently verify all information contained in a Guide before using it for travel planning. In particular: verify addresses using Google Maps or other sources; check prices on official restaurant/attraction websites; confirm opening hours; verify that a location exists before visiting.
5.4 No Training on User Data
Content submitted by the User (video URLs, preferences) is not used to train AI models — by AI providers or the Operator. The Service uses AI providers in production mode under a "no data retention for training" policy, pursuant to the respective Data Processing Agreements.
5.5 Automated Decisions
Guide generation is an automated process, but it does not produce legal effects on the User and does not significantly affect their situation within the meaning of Art. 22 GDPR.
6. Free Plan and Pro Plan
6.1 Free Plan — Features and Limits
Under the Free Plan, the User receives:
- 2 free Guides upon registration,
- +1 free Guide every week,
- analysis based on audio transcription only (no image analysis),
- support for videos up to 30 minutes,
- interactive map, quotes with timecodes, ratings.
Free Plan limitations: no image analysis (menu prices, signage text, food shots); no support for videos longer than 30 minutes; no YouTube Shorts support; no live stream support. Current limits and features are always available at /payment.
6.2 Pro Plan — Credits
The Pro Plan enables: full analysis (audio + image); support for videos of any length; YouTube Shorts support; identification of prices from menus and signs; identification of dishes visible in video frames; identification of places not mentioned in narration.
6.3 Packages and Pricing
Current packages, prices, and Credit amounts are always available at /payment. Prices shown are final prices.
6.4 Generation Cost (Credits)
The current generation cost (number of Credits based on video length) is available at /payment.
6.5 Credits Do Not Expire
Purchased Credits do not expire and remain in the User's account until used or the account is deleted.
7. Payments
7.1 Payment Processor
Payments are processed by Stripe Payments Europe Limited (Ireland). The Operator does not process card data — all payment handling is performed by Stripe (PCI-DSS Level 1).
7.2 Merchant of Record
The merchant and entity issuing purchase confirmations is EAST WEST CONSULTING sp. z o.o., Aleja Grunwaldzka 472, 80-309 Gdańsk, NIP 8371818070.
7.3 Currency
Payments are made in EUR. Currency conversion is handled by the User's card issuer or bank.
7.4 Payment Processing
Credits are added to the User's balance immediately upon successful payment authorisation (typically within 1–30 seconds). A purchase confirmation is sent to the User's registered e-mail and is accessible in the account panel.
8. Withdrawal and Complaints
8.1 Digital Content — Loss of Withdrawal Right
Pursuant to Art. 38(13) of the Polish Consumer Rights Act, the 14-day withdrawal right does not apply where the Operator has begun performing the service (delivering Credits to the account) with the consumer's express prior consent, and the consumer was informed before performance began that they would lose the withdrawal right.
By placing an order for a Package, the User consents to the immediate commencement of service delivery and acknowledges that they lose the right of withdrawal once Credits are delivered. Consent is given by checking the relevant checkbox during Stripe Checkout.
8.2 No Refund for Used Credits
Used Credits (consumed by generating a Guide) are non-refundable.
8.3 No Refund for Unused Credits
Unused Credits are not refunded in cash, but they do not expire and the User may use them at any time.
8.4 Credit Refund for Service Error
If Guide generation fails due to Operator fault (technical error, AI failure, API unavailability), Credits are automatically refunded to the User's account. If the automatic refund does not occur, contact support@in-thecity.com.
8.5 Complaints Procedure
Complaints to support@in-thecity.com — include e-mail address (for account identification), description of the issue, date and time of the event, preferred resolution. The Operator will respond within 14 days of receipt.
8.6 Out-of-Court Dispute Resolution
Consumers may use the European Commission's ODR platform: https://ec.europa.eu/consumers/odr
9. Third-Party Content (YouTube)
9.1 Nature of Analysis
The Service analyses publicly available video content from platforms such as YouTube, via the official AI provider API and the YouTube Data API. By using the video analysis feature, Users are also bound by YouTube's Terms of Service and Google's Privacy Policy.
9.2 No Download or Storage of Videos
The Operator does not download, copy, or store original video files. Only the following are processed: public video metadata (title, description, duration, author) via YouTube Data API; image and audio analysis by the AI provider (on the provider's side); the resulting dataset (places, quotes, ratings) generated by AI.
9.3 Quotations (Right of Quotation)
A generated Guide may contain short quotes from the analysed video (1–3 sentences), with attribution including the creator's/channel's name, a timecode reference in the original, and a link to the original video. Quotation is carried out for the purposes of explanation, critical analysis, and commentary under the right of quotation within the meaning of Art. 29 of the Polish Copyright Act of 4 February 1994 and Art. 5(3) of Directive 2001/29/EC.
9.4 Copyright
All copyright in original videos remains with their creators. Using the Service does not grant Users any rights to original materials.
9.5 Takedown Procedure (Content Creators)
If you are the author of a video analysed by the Service and wish to have a specific Guide removed, Guide generation from your content blocked, or your entire channel excluded from analysis (blacklist), please contact support@in-thecity.com. Include a link to your YouTube channel, link to the specific video (if applicable), and proof of identity (e.g. a message from the official channel address or a verification link in the channel description). Requests are processed within 14 days.
9.6 Non-Affiliation
The Service is an independent technology tool. The Operator is not affiliated with, sponsored by, endorsed by, or officially associated with YouTube LLC, Google LLC, any video content creators, or any brands/restaurants/attractions/places mentioned in generated Guides. All trademarks, logos, and trade names belong to their respective owners.
10. Referral Programme
10.1 Programme Rules
Each User has a unique referral code available in their account panel. When a person who registered using that code makes a purchase, the inviting User earns a share of that purchase. Current programme terms — the share, the qualifying period and the payout method — are published in the User's account panel and may be updated by the Operator from time to time.
10.2 No Bonus for the Referred Person
The referred person receives standard Free Plan limits upon registration. No additional benefit is granted to the referred person as a result of the referral.
10.3 Anti-Fraud
Self-referral is not permitted. A person may be referred only once (first referral counts). Suspicious patterns (e.g. mass registrations from one IP) result in cancellation of the corresponding earnings. In the event of detected abuse — the account may be blocked without any payout (Section 13).
11. Intellectual Property
11.1 Operator's Property
The Operator owns the Service's source code, design and interface, selection and aggregation algorithms, the trademarks "In The City", "city ai" and derivatives, and documentation. Use of these elements beyond normal use of the Service requires the Operator's written consent.
11.2 Generated Guides — Licence to the User
The Operator grants the User a non-exclusive, non-transferable, personal licence to use generated Guides for personal purposes (planning personal travel), to share a Guide with friends (via link), and for personal printing.
11.3 Prohibition on Commercial Resale
The User may not sell generated Guides, publish them on other commercial platforms, use them to train competing AI models, or resell access to the Service (e.g. as a managed service).
11.4 Third-Party Content
Content generated on the basis of YouTube videos (quotes, place recommendations) is subject to the rights of the original creators (Section 9).
12. Prohibited Use
12.1 Technical Abuse
Reverse engineering of the Service's code, API, or AI models; bulk scraping of generated Guides; circumventing Free Plan limits (e.g. creating multiple accounts); using bots or automation without the Operator's consent; attempts to attack the infrastructure (DDoS, injection, etc.).
12.2 Content Abuse
Generating Guides to spread unlawful content; analysing videos to which the User does not have public access; using the Service for stalking or other forms of harassment; generating Guides designed to mislead third parties.
12.3 Commercial Abuse
Reselling Credits or access to the Service; using the Service as a white-label product; generating Guides for the purpose of competing with the Operator.
13. Account Suspension and Termination
13.1 Grounds for Blocking
The Operator may suspend or block a User's account in the event of: breach of the Terms of Service (Section 12); suspected payment fraud; third-party reports (e.g. copyright infringement); suspected unauthorised use of the account; abuse of the referral programme.
13.2 Blocking Procedure
The Operator sends an e-mail notification of the block stating the reason. In the event of a serious breach (e.g. fraud, infrastructure attack) — the block may take effect immediately, without prior warning.
13.3 No Refund
In the event of account blocking due to User fault: unused Credits are not refunded; account data is retained for 30 days (allowing an appeal), then deleted.
13.4 Appeal
The User has the right to appeal a blocking decision by contacting support@in-thecity.com within 30 days. A response will be provided within 14 days.
14. Limitation of Liability
14.1 Nature of the Operator's Liability
The Operator provides the Service "as is". The Operator is solely responsible for ensuring the technical functioning of the Service (best effort), correct Credit accounting, protection of personal data in accordance with GDPR and the Privacy & Cookie Policy, and handling complaints within the specified timeframe.
14.2 Exclusions of Liability
The Operator is not liable for the accuracy, completeness, or currency of generated Guides (AI hallucinations — Section 5); User decisions made on the basis of a Guide (bookings, expenditures, travel); damage occurring during travel based on the Service's recommendations (food poisoning, theft, accidents, costs of plan changes); unavailability of places listed in a Guide (closed restaurants, demolished buildings, outdated prices); YouTube creators' content (quotes and recommendations derive from analysis of their videos); third-party provider outages (Google Gemini, Stripe, Supabase, Google APIs); data loss resulting from failures or errors on the part of sub-processors (the Operator performs regular backups); malfunction of the User's device or browser.
14.3 Maximum Liability
To the extent permitted by law, the Operator's maximum liability to a User in respect of any claims arising from use of the Service is the amount paid by the User for Pro Packages in the 12 months preceding the claim, or €100 — whichever is higher. This limitation does not apply to liability for intentional damage, gross negligence, or liability arising from mandatory provisions of law (in particular, consumer protection law).
14.4 Consumer Rights Unaffected
The above limitations do not affect consumer rights arising from mandatory provisions of Polish law.
15. Personal Data and Cookies
The rules governing the processing of personal data and the use of cookies are described in detail in the Privacy & Cookie Policy. In particular: the data controller is EAST WEST CONSULTING sp. z o.o.; we collect only the e-mail address as personal data; we do not use User data to train AI models; sub-processors are listed on the privacy page; we apply Standard Contractual Clauses for transfers to the USA; necessary cookies operate without consent.
16. Communication with the User
16.1 Communication Channels
E-mail sent to the address provided at registration (transactional notifications, Terms changes); notifications in the account panel.
16.2 No Newsletter at Present
The Operator does not currently operate a marketing mailing list. Should a newsletter be launched in the future — it will require the User's explicit opt-in consent.
17. Changes to the Terms of Service
17.1 Good Faith and Early Stage of Development
The Service is in an early stage of development — inaccuracies or areas requiring clarification may arise. The Operator commits to promptly correcting any errors upon their detection or notification. If you notice an error, please contact support@in-thecity.com.
17.2 Right to Amend
The Operator reserves the right to amend the Terms of Service for legitimate reasons, including changes in legislation, changes in Service functionality, changes in package pricing, changes in sub-processors.
17.3 Notification of Changes
The Operator will notify Users of material changes by e-mail to the registered address — at least 14 days before the changes take effect, by a prominent notice in the Service, and by updating the date at the beginning of the Terms.
17.4 Non-Acceptance of Changes
If the User does not accept the changes, they may delete their account before the changes take effect (unused Credits may be refunded by exception — contact support@in-thecity.com), or cease using the Service.
18. Final Provisions
18.1 Governing Law
These Terms of Service are governed by Polish law and European Union law.
18.2 Jurisdiction
All disputes shall be resolved by the Polish courts having jurisdiction over the Operator's registered seat (Gdańsk). For consumers — jurisdiction shall be determined in accordance with consumer protection rules (the court with jurisdiction over the consumer's place of residence).
18.3 Language
The Terms of Service were drawn up in Polish. In the event of translations into other languages, the Polish version shall prevail.
18.4 Severability
If any provision of the Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.5 Entry into Force
The Terms of Service entered into force on 28 April 2026. This version (1.2 EN) applies from 3 May 2026.
